Yes they can, but not until the case is over.

Trump is an outlier here. most POTUS's leave office with about 10-20M NW.  That's not cash in pocket.

To get an idea:
Hunter is involved in 2 cases, neither of which have started yet.
One of the guys backing him has already spent 10m for Hunters Lawyers/legal fees and is tapping out now.

So even if you are truly innocent and it's a political game being played against you, you still have to have the money up front to CYA else you'll get hammered to the wall.

That's a bad example, though, because Hunter did illegal things and is playing at technicalities to get out of it.

It's a simple example, leave it at that. It shows that the costs of legal work far outweighs his NW. Hasn't even started and his backer is broke already. Hunter doesn't have the kind of money to get out of this. And my point is a possible POTUS candidate might consider this before running. I don't think Trump will go after Joe if he wins, but who knows. If he does do something,, Joe could also be broke before the case even starts.

He has said that he will. He is running on a platform of vindictiveness.
