This is one of those things that really irritates me. First, let me say that I am in favor of certain immunities for government officials because especially in today's hyper-partisan environment it would be difficult for administrators to do their jobs without it. However, there is a level of deference that has been given in these cases is concerning to me. There is a fine balance that needs to exist in the immunity doctrine to balance the rights of the public versus the interests of the state. This sort of language plays into this. The idea of an officer or any government official being "rogue" immediately disqualifies them from immunity because immunity should not exist without following established protocols and procedures. Going "rogue" implies a detachment from the established rules. Stuff like this is concerningly un-democratic.
