The state has to show enough evidence to the grand jury to justify bring charges.  It is up to the grand jury to decide if the state has enough evidence.

The defendant does not even appear beforew the grand jury, but in these cases it seems like the Prosecutors are defending the police they work with every day instead of actuaslly prosecuting the cases.
