I watched a First 48 where two guys held up some place, and the owner shot and killed one of them.  The other guy was charged with 1st degree homicide in his death.

Felony murder rule.  Not being a DA in Maryland I'm not sure how it doesn't apply.  The law does tend to do what it feels like at times though.
