That's why time is an element and plays into the common sense aspect. If they've been on hormones — especially since puberty — then they likely won't have much of a difference from other kids of that sex. There's minor differences in muscle mass and size between an 8 year old boy and an 8 year old girl. It take a few more years (typically) before hormones start building those different physical characteristics.

That's why I'm not a fan of a hard rule.
