That's separate from the question on if you have an illegal immigrant standing right there, proclaiming they're an illegal immigrant... why haven't they be sent away?
There could be a charge, or it could just be another minor. Or it could be another illegal immigrant. The child will only be a US citizen if it's born on US soil, which if they send the admitted illegal immigrant away as the law is supposed to work. The child won't be a US citizen in that case unless a father, who is a US citizen themselves, steps up and claims it as well as being not old enough for it to be a crime.
Of course that's all off the basis of IF she doesn't get the abortion that she wants, so it's still a null point until 30 weeks pass. Until then it's still a question of why they're arguing over this in courts when the answer is staring us right in the face. Send her away and let her country decide.
