That is what I understand, as well. Also, his agent went down for having child porn on his computer. There was also someone to come forward, saying that Fogel had made some inappropriate remarks on the set of his commercials, that may have lent a clue as to his true nature, some time back.
What I thought most interesting about this entire ordeal, was the fact that Subway completely cut ties and "erased" any mention of Fogel from any of their marketing, the moment his agent was charged. That tells me that Subway may have known that something was up, long before legal actions were taking place. Personally, I don't patronize their business anymore, for that reason.
