Every American is covered on the basis of race, color, religion, sex, national origin, disability, and age. As it stands, there's no federal protection against discrimination based on one's sexual orientation or gender identity.

Really?  Then where did all those lawsuits against businesses that discriminated against the gay community come from, just a few years ago?  That was National headlines.

Some judges side with those being discriminate against by saying it's "sex based". Some don't. It's like how the Obama administration used similar language under title IX banning sex based discrimination to prevent LBGT discrimination in schools while the Trump administration has reversed that policy and said they won't actively go after schools that's discriminate on this basis.

Here's another example with how it applies to employment where the Trump administration has asked the courts to rule that employers can discriminate on the basis of sexual orientation where the Obama administration hold an opposing stance.

If these cases went to the Supreme Court and they ruled in favor of those saying it covers LGBT, it'd be a nation wide protection. Until then, district precedent determines.
