Although his guilt is pretty obvious, he hasn't been convicted of anything.

His bail was only set at $150,000, and although I think it should have been more, bail is typically low for those with no criminal history, violence issues and potential danger to the community, flight risk, etc...   Even with a higher bail, he likely would have been able to make it.
