He doesn't need to be a suspect, he exited a vehicle, with a visible weapon, while police activity was going on. It is their job to notice him, for all they knew, he could have been there to aid and abet the warrant suspect. The rule is, obey the officer. Let them sort out their business, if you are in the right, you get to go about your business.
