The reason Comey didn't pursue prosecution was because he said he didn't feel it was worth pursuing since it would be hard to prosecute someone based on carelessness rather than intent.
One critical point to remember is that she was not passing information to anyone, and had no intent to. Looks like she was mostly trying to keep her own emails from others scrutiny.
