I don't know the set up in every state, but it's not just private prisons that profit in Kentucky. There are a lot of regional jails operated by counties that handle detainees for smaller counties and inmates from state/federal institutions. It's an on again off again problem for those jails. They serve as regional jails, but the only way they can keep a facility that size going is to have X number of inmates.

I'm very much against for profit prisons, but it's not just a problem with how businesses work.
