As a side, it's always been a principle of the federalist system that if the national government had a law (and the authority to make said law) setting guidelines that the states could implement more strict guidelines, but not more lax ones. The precedent this argument sets blows this idea out of the water and could be used to challenge a number of laws around the country, effectively demolishing our entire federalist system.
