I believe California goes based on physical sex. So a sexual reassignment surgery means female prison.

I didn't know so I looked it up. Apparently in the last episode that aired of her documentary/reality show, she submits the paperwork. That was filmed in the beginning of July, so at the very least she has gone through all of the legal steps months ago and may just be waiting on the paper pushers.
