Honestly, I don't know all the ins and outs of it. From my very limited understanding of the DoE position, if a trans woman is told she cannot use female facilities because her sex is male. Therefore, it is consider discrimination based on sex because it is basing the action on her biological sex and not gender.

This is what I remember from the most recent Title IX training I sat through.
