I'd imagine, in a fine issuing situation, it would have to be witnessed first hand by a teacher.
There would also need to be a state defined list of detailed offenses.
I would also require all teachers take a coarse in evaluating these situations.
I would also add that a single verbal offense would not qualify.
Verbal issues would need to be repeated, after the first counseling session from the initial offense.
