There is a lot of "sky is falling" surrounding this ruling because the order seems to leave open the idea of Trump being able to claim executive privilege. However, the order specifies for congressional investigations. You cannot claim executive privilege against the executive branch as the concept of it is designed to privilege information of the executive branch from the other two.
For the record, expect an appeal. The order includes an injunction on the investigation which it is immediately appealable. Plus, there are questions surrounding the jurisdiction of the judge in this case as Trump's team judge shopped and this is not where the order originated for the search, which is where it should have been brought.
Right, this will be overturned on appeal. Again, a very odd and contradictory ruling. The judge even went as so far to answer questions no one asked which makes this even worse when you step back and look at it.

Oh, the ruling is atrocious and ridiculously flawed. The only way this ends in a positive for Trump is if the 11th Circuit and/or SCOTUS help him delay the process.

1st: I'm not a lawyer.
2nd: From what I am reading the bad part about this is the judge basically made silk from a sows ear. Trump's "lawyers" didn't do much of anything right but she went ahead and gave him what he should have asked for...and what he probably should not have received anyway.
But delaying is DJT's favorite way to kill everything.

The Washington Post is reporting that some of the documents did in fact relate to a foreign nation’s nuclear capability. Documents considered so sensitive that only the most senior officials are allowed access to them. Documents so important that they don’t end up in a box in Trump’s Florida office by accident. And documents covered by laws that prevent declassification via Trump’s magic incantation. In fact, they ar3 documents so secret that any other person caught with them like Trump has would be looking at serious time in Pa federal penitentiary

Not even close.
I'm sure it makes Republicans feel warm and fuzzy that these were found but know they have to admit the search of Trump's home was correct and not a "raid" and that the difference between refusing to return them and denying you had them and what Biden's lawyers did is black and white.
Add to that that Democrats have said go ahead and investigate Biden and see if he did something illegal.
But then I don't expect much from the right when it come to holding their own accountable.

Imho that seems a tad unfair. For one, Trump had to be raided because he denied his wrongdoing and was uncooperative, that does not apply to the Biden situation. And second, Dems did not know that Biden story when they were outraged about Trump.
Aside from that, we'll see how this keeps playing out. Someone is responsible and needs to be held accountable. If the narrative goes in the "no harm, no foul" direction, then I will further agree with your sentiment (I already do agree with it to a certain extent).

It is Trump's own propensity for lying, denying, and confrontation that has him in this position over the documents. All he had to do was give them back when asked and it would be a "no harm no foul" situation. The documents were accidentally taken and given back when discovered, like what happened with Biden. But Trump had to throw a tantrum like a 3-year-old screaming "mine" He is really his own worst enemy sometimes

Meanwhile, they continue to go full root-rooter on DJT without the burden of him being able to accuse them of bias....

This is my fun conspiracy theory. The delay in this hitting the news cycle was 100% about the mid-terms, but now that those are out of the way they made sure this hit the news well before the cycle for 2024 really kicked off. The DNC wanted it to happen to push Biden out of the running because they really don't want him on the ballot.
What we're seeing here, the classified documents taken in this manner, is not entirely uncommon and also isn't a huge deal (if you're not current POTUS can result in you losing access to intel), but the context of it in relation to Trump's fiasco (which was a big deal because he is a man child) makes this more of a story. I can really see the DNC or folks on the inside of the party seeing this as an opportunity to push Biden off the ticket in 2024, knowing that this is a common thing and that the timing for the context would be perfect. What we don't know, though, is what the attention span of Congress or the public will be.

Well. Garland applied a special council toward Trump at the same time he knew of this Biden story. Doesn't make Garland look great either. Justice can be blind if there is some omitting involved with it.

At which point he had someone working to determine whether a special counsel was necessary. Keep in mind that the special counsel for Trump is not really about the documents themselves. It is about the actions of Trump and his employees that (allegedly) obstructed government actions to regain those documents and (allegedly) lied to the government in the course of those events. This is why it is a false equivalency to try to talk about the Biden and Trump cases as if they were the same.

If Biden continues to ignore the subpoena for the hundreds of intel documents he took,
Then the FBI should raid his home.
Otherwise there is a double standard.
Biden should have notified the FBI and N. Archives and returned the documents as soon as his lawyers found them.

Well no, I'm sorry to correct you on this, but
I have been watching Fox News for the last two days.
The real issue is that Trump had some documents in his home and Biden acted like he was all incompetent
--then documents were found in Biden's office/home.
But Trump can de-classify documents if he wants to take them home, and Biden could NOT do that as vice president.
So Biden is a liar and a hypocrite because he didn't let the DOJ raid his home.
And he is in more legal trouble since he could not declassify the documents he stole.
(Mark Levin emphasized this in a Hannity interview 1/12/23.)
Dems will try to make this a legal issue and distract us with talk of "intentionality," "obstruction" and "criminal intent."
If a Trump lawyer signed off on a letter claiming all documents had been returned, then she should be prosecuted for
lying, not Trump.
People should not be fooled just because Biden reported and returned the documents as soon as found.
This is about how the documents were stored--one set in a DOUBLE-locked basement and the other in a garage--
NOT about whether someone intentionally stole hundreds of classified documents he could not and had not declassified, and then
fought to illegally retain them by deceiving the DOJ--or should I say continues to fight to retain them.
